Jim Jordan’s Judiciary Committee Threatens the First Amendment Rights of American Businesses

The Republican Party has long sought to be the torch carriers for corporations, spearheading their interests by slashing taxes and regulations to the detriment of the American people who are forced to take up the slack. But then, it was the GOP justices on on the Supreme Court who decided that corporations are, in their warped view, people.

Donald Trump, Boycott

Somehow, that pro-corp bias on the part of the right has been flipped as Republicans are now feverishly engaged in battle with the businesses and lobbyists that they previously catered to. It isn’t a coincidence that this transformation took place during the era of Donald Trump, who has turned “retribution” for any ideological divergence from his doctrine into a political mandate. It’s framed as a “War on Woke,” whatever the heck that means.

This diseased philosophy is bad enough when it is espoused by individual politicians and pundits. But it is significantly worse, and more dangerous, when the official gears of governmet are grinding it out. Which is precisely what happened on late Wednesday night when Jim Jordan, the Republican chair of the House Judiciary Committee, tweeted this: “Bud Light. Disney. Target. Go WOKE. Go BROKE.”

First of all, if anything is “broke” it’s Jordan’s brain. The companies he is singling out are not remotely at risk for going broke. They are, in fact, among the most profitable businesses in the country/world.

More to the point, what Jordan is doing here is overtly threatening American companies with bankruptcy, or other financial vengeance dealt out by the government, for daring to exercise their constitutional rights under the First Amendment. In this case, the companies offended Republicans by expressing their support for their LGBTQ+ customers. Which is, of course, entirely legal, not that Jordan or the GOP care.

This is not merely an attack on American companies conducting business as they see fit. It is an attack on American workers who would be harmed if these companies suffered financially due to Jordan’s unlawful, autocratic bullying. It is also an attack on local economies that could suffer when businesses are forced to alter their growth plans. Just ask Ron DeSantis, whose feud with Disney resulted in the company canceling plans for an office – and 2,000 jobs – in Florida after he began retaliating against them for rejecting his bigotry.

These neo-fascist tactics by the Trumpian GOP are not new. Jordan recently threatened the anti-trust status of Major League Baseball. Not because that status may not be warranted as a matter of economic policy, but because the League scheduled a “Pride” night to honor their LGBTQ+ fans. And Trump himself has advocated for boycotts of dozens of American companies, including Apple, Coca-Cola, AT&T, Citigroup, Oreos, etc.

FOR INSTANCE: Trump is “The King of Cancel Culture” who “Hypocritically Calls for Boycotts.”

Jordan is not alone in his mission to tear down American companies. He is joined by the GOP’s misnamed “Freedom Caucus” and by, of course, Fox News. Yet all of these fatuous phonies persist in pretending to be pro-business and free speech. But their lies are on display where everyone can see them. They hate American business. They hate American workers. They hate America.

Ron DeSantis Seeks to Muzzle the Media with Unconstitutional Libel Law Reforms – Just Like Trump

There is clearly something in the swamp water in Florida that makes its Republican politicians emulate the anti-American derangement of one another. That would account for how Ron DeSantis, while ostensibly preparing to challenge Donald Trump for the 2024 GOP nomination for president is, instead, turning into an even more extreme copy of the twice impeached, former reality TV game show host.

Politico is reporting that the majority Republican Florida legislature is drafting a bill that would severely threaten the free press were it to be found constitutional – which it surely would not be if the Supreme Court were occupied by fair-minded Justices. To be sure there are some serious problems with the media as witnessed by the lawsuit filed by Dominion Voting Systems against Fox News.

However, the reforms sought by DeSantis are dangerously oppressive and intended only to intimidate journalists and silence his critics. According to Politico

“At the governor’s urging, Florida’s Republican-dominated Legislature is pushing to weaken state laws that have long protected journalists against defamation suits and frivolous lawsuits. The proposal is part [of] DeSantis’ ongoing feud with media outlets like The New York Times, Miami Herald, CNN and The Washington Post — media companies he claims are biased against Republicans — as he prepares for a likely 2024 presidential bid.

“Beyond making it easier to sue journalists, the proposal is also being positioned to spark a larger legal battle with the goal of eventually overturning New York Times v. Sullivan, the landmark 1964 U.S. Supreme Court ruling that limits public officials’ ability to sue publishers for defamation.”

The DeSantis proposal would make it easier to sue media for defamation. It would also remove journalists’ protection from having to reveal confidential sources, and mandate by law that such reported comments are presumed false in court proceedings. These reforms are contrary to the Constitution and 250 years of legal precedents. They would have a chilling effect on the press and discourage honest reporting.

That discouragement is, of course, precisely the goal of DeSantis. He has assumed the identical position of Trump – and their authoritarian heroes like Vladimir Putin, Kim Jong Un, and Xi Jinping – with regard to suppressing the media. Politico notes that DeSantis has been “refusing to conduct interviews with platforms except Fox News.” That was the same strategy employed by Trump for most his campaigns and presidency. Although lately Trump has taken to even attacking his Ministry of Propaganda, Fox News.

However, DeSantis is actually taking this unconstitutional obsession even farther than Trump by committing it to law. Trump often threatened to do so, but never followed through. In January of 2018 Trump whined that

“Our current libel laws are a sham and a disgrace and do not represent American values or American fairness. So we’re gonna take a strong look at that.”

Perhaps the reason that Trump chickened out was because he would have opened a can of worms that would have devoured him. No one has exposed himself to more potential libel allegations than Trump. Every time he calls a reporter a liar, or asserts as fact that unnamed sources don’t exist, or alleges that a story was deliberately made up, or unleashes one of his infantile and insulting nicknames on a reporter, Trump is slandering those reporters and harming their reputations and careers.

Someone may have warned Trump to be careful what he wishes for. After all, there have been literally thousands of comments and tweets by Trump that were demonstrably false, but manifestly injured their targets. For instance, what about the sixteen women who have spoken out about Trump’s sexual abuse? He called every one of them liars? One of them, E. Jean Carroll, is currently suing him for defamation.

If DeSantis were smart (doubtful), he would abandon these ill-considered reforms. They are only likely to backfire on him. There are already plenty of safeguards in current law that protect people from deliberate slander and libel. Even if committed by the media. Just ask Dominion Voting Systems.

That, however, isn’t sufficient for Republican press haters who are more interested in censorship than freedom. Consequently, politicians like Trump and DeSantis, who are afraid of a free press, are seeking to shut it down. Trump has already gone to great lengths to do so, and in the process proved that current laws are more than adequate.

Herr Trump Embraces Fascist GOP Threats to Regulate Twitter and Arrest Their Executives

During his brief but abominable occupation of the White House, Donald Trump distinguished himself from his predecessors by relentlessly expressing his aversion to the free press and the Constitution. He repeatedly referred to the media as “the enemy of the people,” and more recently literally called for termination of the Constitution.

On Wednesday the newly GOP-led House Oversight Committee held a hearing to finally get to the bottom of the Scandal of the Century, Hunter Biden’s stolen laptop. Specifically the Committee sought to prove that the pre-Elon Musk Twitter regime had deliberately skewed their policies to adversely affect conservatives and Republicans and, especially Donald Trump.

The Republicans staged a shamelessly shallow exercise in feigned outrage over imaginary offenses that was triggered by the embarrassingly ineffective attempt by Musk’s “Twitter Files” “exposé” to unveil political bias on the part of Twitter’s previous staff.

Notable during the avalanche of asininity on the part of Republican members of the Committee, were the remarks by Clay Higgins of Louisiana. When it was his turn to question the Twitter executives who were summoned before the Committee to testify, Higgins launched into an unhinged flurry of baseless accusations and culminating in outright threats:

“You, ladies and gentlemen interfered with the United States of America 2020 presidential election, knowingly and willingly. That’s the bad news. It’s gonna get worse because this is the investigation part. Later comes the arrests part. Your attorneys are familiar with that.”
Marjorie Taylor Greene said the same thing.

What we have here is a member of Congress threatening to have witnesses arrested for unspecified crimes for which he has no evidence ever occurred. What Higgins is asserting as criminal is the exercise of the constitutional rights of a private social media company to moderate the content on its website. It is wholly inappropriate intimidation by a government official seeking to coerce the behavior of individuals to comply with his political beliefs.

That sort of authoritarian bullying is generally reserved for tyrants and dictators, and those who seek to emulate them. And speaking of Donald Trump… He was thrilled to see how Higgins browbeat the Twitter execs. He posted a video of Higgins along with with his approval on his pitifully failing Twitter ripoff, Truth Social, saying that…

“Finally we have people with courage stepping forward! The Election was Rigged and Stolen, in so many ways – A mockery of our fully weaponized ‘Justice’ system.”

[For the record, the tweet that Trump was so appalled by that he wanted Twitter staff arrested was by supermodel Chrissy Teigen, who called Trump a “PAB” (look it up) for being too cowardly to tag her in his tweet that insulted her]

Of course, there was nothing in Higgins remarks – or in the entirety of the hearing – that even hinted at any evidence that the “Election was Rigged and Stolen.” To the contrary, Democrats on the Committee conclusively proved that the only bias by Twitter was in favor of Trump and the GOP. Even worse, in questioning by Rep. Gerry Connolly (D-VA) it was affirmed that only the Trump White House ever attempted to direct Twitter to censor content. And it did so with an overt threat that, “We’ll shut you down. We’ll regulate you. We Will never allow this to happen.”

That is an example of unambiguous government suppression of a free press and a violation of the First Amendment. Nevertheless, Rep. Jim Jordan tried to turn the tables by accusing the Biden campaign of censorship simply because they made a request for Twitter to review certain offensive tweets. Jordan’s argument, however, was ridiculous. He claimed that asking Twitter to review whether tweets were in compliance with their own terms of service was censorship.

Obviously, it’s not against the First Amendment to ask a company to review content based on the company’s own standards. What’s more, the Biden campaign not only didn’t accompany their requests with threats, they weren’t even in power at the time, so they had no clout with which to threaten. And yet this is the scenario in which Trump posted a comment urging his cult to “Watch the Twitter hearings going on right now in Washington. They admit that the Presidential Election of 2020 was RIGGED & STOLEN!”

Naturally Trump is lying. No such admission occurred in the hearing. But Trump’s flagrant dishonesty is precisely the sort of provocation that resulted in the riots in Washington on January 6th. And his continued presence on social media (both Twitter and Facebook recently reinstated his accounts) will predictably result in more violence.

FFS: Trump Calls for Arrest of Supreme Court Leak Journalists Unless They Reveal Their Sources

During his occupation of the White House, Donald repeatedly demonstrated his ignorance of, and disrespect for, the Constitution of the United States. He pursued an agenda that was most closely associated with fascism and other oppressive models of government. He expected unflinching loyalty to him personally, rather to the Constitution or the nation.

Trump’s biggest heroes are dictators such as Kim Jong Un, Xi Jinping, and his puppet master, Vladimir Putin. He excused their offenses against free nations and he sought to emulate them. He spoke of having “fallen in love” with Kim Jong Un and he openly stated that he believed Putin over American intelligence agencies.

On Thursday Trump responded to a report regarding the leaked draft of the the Supreme Court’s decision on Roe v Wade. The investigation was unable to identity the leaker who provided the press with a draft of the opinion. That news triggered Trump to post a comment on his floundering Twitter ripoff, Truth Social, saying that…

“The Supreme Court has just announced it is not able to find out, even with the help of our “crack” FBI, who the leaker was on the R v Wade scandal. They’ll never find out, & it’s important that they do. So, go to the reporter & ask him/her who it was. If not given the answer, put whoever in jail until the answer is given. You might add the publisher and editor to the list. Stop playing games, this leaking cannot be allowed to happen. It won’t take long before the name of this slime is revealed!”

And just in case anyone was unsure about his position, Trump followed that up with another post that said…

“Arrest the reporter, publisher, editor – you’ll get your answer fast. Stop playing games and wasting time!”

These remarks are typical of Trump’s tendency toward tyranny. They reveal his seething hatred for the Constitution and the freedom that it mandates for the press.

For the record, it is not illegal to leak drafts of Supreme Court opinions to the press, so long as the leaker didn’t gain access to the documents unlawfully, such as hacking into a private computer. But Trump isn’t talking here about arresting the leaker. He’s demanding that the reporters, editors, and publishers of the documents be arrested to coerce them to reveal their source. According to PolitiFact

“No federal law clearly prohibits someone with legal access to a draft Supreme Court opinion, such as a justice or clerk, from leaking that document to the press, legal experts said. A draft opinion is not classified, which is usually the grounds for leak investigations.”

The journalists involved in this not only did not violate any law, but they are protected by the Constitution and a couple hundred years of subsequent affirming decisions by the Supreme Court. Nevertheless, Trump would have them incarcerated until they talk. That is the sort of tactic that would be exercised by Trump’s totalitarian mentors. It is blatantly illegal, grossly offensive, and wholly un-American.

These comments are further evidence that Trump is unfit to serve in any capacity in a free democracy. And any voter or Republican politician who would support Trump’s future electoral aspirations is embracing his treasonous anti-Americanism and his utter lack of patriotic principles.

Trump Doubles Down on His Constitution Bashing and Misquotes Himself to Gaslight His Cult

On Saturday, December 3, 2022, Trump spoke more explicitly about his anti-democratic, authoritarian aspirations than ever before. On his floundering Twitter ripoff, Truth Social, Trump raged that the Constitution should be “terminated” in order to satisfy his election fraud fantasies and his voracious lust for power.

Not surprisingly, the media (with the exception of Fox News, which we’ll get to below) reacted appropriately to Trump’s totalitarian temper tantrum. It is obviously newsworthy when a former president, and current presidential candidate, advocates dispensing with the Constitution that he would be oath bound to uphold. And just as unsurprisingly, Trump is now lashing out the media for reporting verbatim what he said. He wrote…

“The Fake News is actually trying to convince the American People that I said I wanted to ‘terminate’ the Constitution. This is simply more DISINFORMATION & LIES, just like RUSSIA, RUSSIA, RUSSIA, and all of their other HOAXES & SCAMS. What I said was that when there is ‘MASSIVE & WIDESPREAD FRAUD & DECEPTION,’ as has been irrefutably proven in the 2020 Presidential Election, steps must be immediately taken to RIGHT THE WRONG. Only FOOLS would disagree with that and accept STOLEN ELECTIONS. MAGA!

So Trump is “actually trying to convince the American People” that he did not say that he wants to “terminate” the Constitution. And he had to misquote himself to do it. What he conveniently left out of his latest harangue (and it’s still on his website) was his assertion that the imaginary fraud that he continues to obsess about would justify “throw[ing] the Presidential Election Results of 2020 OUT and declar[ing him] the RIGHTFUL WINNER,” and furthermore, “allows for the termination of all rules, regulations, and articles, even those found in the Constitution.”

As Trump says, “Only fools would disagree” that he is deliberately editing his grossly offensive and un-American tirade. Fortunately for Trump, there are still a few fools willing to commit to his cult. Sadly, Fox News is still among them.

On Monday’s episode of Fox and Friends, the “Curvy Couch” potatoes did a segment on Elon Musk’s Twitter nothingburger about alleged leftist bias and suppression of stories about Hunter Biden’s stolen laptop. The whole “revelation” amounted to rank speculation, fabrication, and the disturbing doxing of private Twitter communications and staff.

Crammed into this segment were a few seconds about Trump’s Constitution trashing. Co-host Steve Doocy complained that…

“I know a lot of people are looking at what Twitter put out and they’re saying ‘There was no smoking gun.’ I think there is a smoking gun. And the smoking gun is that it worked. That that story about the laptop was censored and – Did it change the outcome of the election? We don’t know for sure. But we do know that there have been polls that have shown that, had people known about the Hunter Biden story and how Joe Biden may or may not have been involved ultimately and the Biden family, that could have changed their vote. Ultimately, would it have changed the outcome of the presidential? Well obviously Donald Trump felt so, because he said yesterday that the Constitution should be thrown out. Which is crazy.”

Notice that Doocy’s validation of the allegations about Twitter consisted of nothing but his own conclusion that some unspecified strategy had “worked.” But in his next sentence he admits that it didn’t actually work, or at least “We don’t know for sure.” Therefore…no smoking gun.

Doocy goes on to claim that some polls, that he fails to identify, suggested that the outcome of the election would have been different had the public been aware of the bogus Biden story. And his validation of that baseless assertion came from another rather dubious source – Donald Trump “felt” it, and it triggered his attack on the Constitution. So that’s that, right?

For the record, Fox News has barely mentioned Trump’s Constitution bashing at all. One other instance was on MediaBuzz, where host Howard Kurtz simply acknowledged that it occurred, then said viewers could make up their own minds, and then cut to a commercial. That lasted less than half a minute. And this is Fox’s media “analysis” show.

There’s a reason that Trump has to misquote himself in order to address the nauseating things he actually says. He needs to alter the reality of his glassy-eyed cult followers into believing that nothing he ever does or says could be wrong. And any suggestion that he is less than perfect is just another hoax and/or scam. It’s the same reason that he has still not condemned the vulgar anti-Semitism and white supremacy of his Mar-a-Lago dinner guests, Ye (aka Kanye West) and Nick Fuentes. Trump can’t malign those Hitler fanboys because he so fervently admires and emulates him, himself.

Trump Literally Calls for Termination of the Constitution and FREAKS OUT Over Bogus Fox News Story

The unsettling totalitarian tendencies of Donald Trump have long posed an imminent threat to American democracy and freedom. From the outset of his political pursuits he has demonstrated a sinister aspiration to tyrannical rule. It’s a symptom of his malignant narcissism that puts the nation – and world – at risk.

Now, more than two years after he was unceremoniously evicted from his occupation of the White House by the American people, Trump continues to peddle his “Big Lie” that the election was “rigged” and “stolen” from him. And although it’s a flagrantly false figment of his diseased imagination, he persists in pushing it out to his glassy-eyed cult disciples, despite his rapidly declining approval and influence.

However, if you thought that he had exhausted his store of preposterous allegations and infantile rage, you don’t know Trump. On Saturday morning he unleashed an avalanche of absurdity in service of his severely acute psychosis. This temper tantrum manifested in multiple posts on his floundering Twitter ripoff, Truth Social. The tedious tirade culminated in the following hysteria

“So, with the revelation of MASSIVE & WIDESPREAD FRAUD & DECEPTION in working closely with Big Tech Companies, the DNC, & the Democrat Party, do you throw the Presidential Election Results of 2020 OUT and declare the RIGHTFUL WINNER, or do you have a NEW ELECTION? A Massive Fraud of this type and magnitude allows for the termination of all rules, regulations, and articles, even those found in the Constitution. Our great ‘Founders’ did not want, and would not condone, False & Fraudulent Elections!”

REALLY? So Trump is now insisting that the Constitution be terminated in order to satisfy his election fraud fantasies and his voracious lust for power. It’s not especially surprising that Trump would hold that view. But it is unusual for him to so forthrightly express it.

The story that Trump regards as a “revelation,” and is so frantically flustered by, came from Fox News. It concerned a couple of Republican attorneys general from Missouri and Louisiana who are suing the Biden administration alleging censorship and suppression of speech by “Big Tech” and the FBI. Their complaint is wholly based on reports that the FBI held regular and normal meetings with the media to alert them to Russia’s attempts to interfere with the 2020 election. But even Fox’s reporting doesn’t assert what Trump and the GOP AGs are twisting these facts to conclude…

“During the deposition, [FBI Supervisory Special Agent Elvis] Chan said that he, along with the FBI’s Foreign Influence Task Force and senior Cybersecurity and Infrastructure Security Agency officials, had weekly meetings with major social media companies to warn against Russian disinformation attempts ahead of the 2020 election, according to a source in the Missouri attorney general’s office. […] According to a source, Chan testified that in those multiple, separate meetings, the FBI warned the social media companies that there could be potentially Russian ‘hack and dump’ or ‘hack and leak’ operations.”

So even according to Fox News there was no conspiracy between the government and “Big Tech” to censor or suppress free speech. It was all just an effort to keep the social media outlets apprised of the Russian disinformation campaign. Also, it’s interesting that Trump is readily accepting this reporting based on allegations by an unnamed source when he has previously dismissed them all as fake.

What Trump, and most of the right-wing echo chamber, is distorting into another pseudo-scandal is an already debunked story. It featured false claims that Facebook CEO, Mark Zuckerberg, told podcaster Joe Rogan that the FBI had ordered him to suppress news about – what else – Hunter Biden’s stolen laptop. Which is not what Zuckerberg said, or what the FBI was doing at all.

In reality, the FBI was doing their job to protect social media platforms, and thus the nation, from Russia’s election interference and fake news manipulation. Which is precisely what Russia was, in fact, doing. But that didn’t stop Trump from demanding that 2020 election be declared invalid, and that he be “declared the rightful winner.”

The Fox News story also reported that “the FBI regularly sends social media companies lists of internet URLs and social media accounts” that distribute “disinformation” from “malign foreign influence operations.” The story falsely implies that this amounts to censorship. Except that the evidence shows that the FBI never imposed any actions to be taken on the social media sites. They merely supplied the sites with information and let them determine for themselves what to do with it. In other words, free speech and the free markets prevailed. Not that Fox News or Trump would recognize it.

Ignoring the obvious facts in this affair, Trump ranted furiously in half a dozen successively incoherent posts that it represented “total corruption” and demanded that someone should “DO SOMETHING as our Country Melts!!!” He didn’t say who, or under what authority, this alleged melting should be halted. It was just more of his now familiar impotent whining and pathetic victimhood. And if the past is any indication, we should expect it to continue – and escalate – as he sinks farther into despair and desperation.

UPDATE I: Trump followed up his alt-tweet storm with another post saying that “UNPRECEDENTED FRAUD REQUIRES UNPRECEDENTED CURE!” He doesn’t specify what that “cure” is, but considering that a short while ago he called for terminating the Constitution, it’s hard not surmise that he’s now calling for another coup attempt or other violent upheaval on the part of his treasonous cult.

UPDATE II: Two days later Trump denied ever calling for the termination of the Constitution, despite his words calling for exactly that, verbatim.

Ted Lieu Offers to Read the Insurrection Clause During McCarthy’s Craven Constitution Stunt

The Trump Republican Party is giddy about the commencement of the next session of Congress. They managed to get the slimmest of a majority, which entitles them to elect the next House Speaker. Currently GOP minority leader, Kevin McCarthy, is presumed to be in line for that post. However, his ascension isn’t guaranteed because the Republican dumpster fire caucus is being smothered by their uber-rightist flank.

Consequently, McCarthy is taking extraordinary and desperate measures to secure his promotion. Among them is his humiliating condescension to extremists like Marjorie Taylor Greene, Jim Jordan, and Paul Gosar. He is promising an authoritarian style reign wherein he will try to unilaterally – and without cause – remove Democrats from their committee assignments. It’s a stance that only makes him look weaker and more incompetent than ever.

This week McCarthy floated another proposition that he believes will earn him the support of his party’s loonies. He announced what he plans to do on the first day of his tenure as Speaker, should he get there. And it has nothing to do with inflation, crime, immigration, abortion, or any of the other unpopular initiatives that Republicans campaigned on. But McCarthy’s proposal was met with immediate blowback by Democratic representative Ted Lieu of California. McCarthy stated his intention to stage a transparently exploitative piece of political theater…

McCarthy: On the very first day of the new Republican-led Congress, we will read every single word of the Constitution aloud from the floor of the House—something that hasn’t been done in years.
Lieu: Dear @GOPLeader: I volunteer to read the Insurrection Clause. Also, shouldn’t you and your party be working on passing bills to help the American people?

Rep. Lieu is now in contention for 2022’s award for “Best Trolling of a GOP Hack.” If McCarthy goes forward with his reading of the Constitution, he’s going to need to decide how to handle the parts that highlight the Republican’s lawlessness and racism. The Insurrection Clause that Lieu referenced seems to apply fittingly to Donald Trump, and many members to the GOP “Freedom” caucus. It says that…

“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection [emphasis added] or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”

If history is any indication, McCarthy won’t be taking Lieu up on his his offer. The last time the Constitution was read from House floor was in 2011, by the newly elected Tea Party Republicans. They deliberately left out the Insurrection Clause. They all also left out the parts describing the “three-fifths compromise” that counted slaves as three-fifths of a person in the calculation of congressional representation. And they skipped over the language that mandated that “runaway” slaves be “delivered up” to their owners. If those are included this time, who will be the unlucky member who has to read them?

Democrats should not allow such revisionist history to be presented this time around. If McCarthy wants to pay tribute to the Founding Fathers and their work, then the entire record should be on display, warts and all. If Republicans don’t like the fact that the original documents oppressed slaves, women, and anyone that didn’t own property, they should be consoled by the amendments that followed, not by censorship.

What they shouldn’t be doing is editing out the parts of the Constitution that they don’t like because it reflects badly on them and what they are pursuing in the present day. But that’s what McCarthy and his confederates are aiming for. He should know that he’s on the wrong track when even his media mouthpieces on Fox News are criticizing his fecklessness and impotency as a leader.

UH-OH: Trump Threatens ‘Major Motion’ Affirming His Grossly Ignorant Grasp of the Constitution

Nearly two weeks ago the FBI served a search warrant on the Palm Beach resort that Donald Trump calls home. What he deliberately mischaracterizes as a “raid” of Mar-a-Lago was a legal operation intended to retrieve national security documents that Trump had swiped from the White House as he was being booted out the door.

In the days following the FBI’s visit, Trump and his protectors in politics and the press unfurled a litany of the lamest lies and excuses for his having violated the law and placing the country in peril. Even his own attorneys were proffering contradictory explanations for Trump’s crimes.

Having failed utterly to present a version of events that approaches reality, Trump is now resorting to a tactic that he has used frequently in the past. He is threatening (pretending) to file a lawsuit to avenge the affront that he feels he has been victim to. Or is he? The statement Trump posted on his floundering Twitter ripoff, TRUTH Social, is a typically confused word salad that barely qualifies as coherent. He wrote that…

“A major motion pertaining to the Fourth Amendment will soon be filed concerning the illegal Break-In of my home, Mar-a-Lago, right before the ever important Mid-Term Elections. My rights, together with the rights of all Americans, have been violated at a level rarely seen before in our Country. Remember, they even spied on my campaign. The greatest Witch Hunt in USA history has been going on for six years, with no consequences to the scammers. It should not be allowed to continue!”

What Trump means by “a major motion” is anyone’s guess. Is it a motion in a proceeding that is already in progress? Is he announcing a new lawsuit? If so, against whom?

Trump’s whining about the FBI’s action being an “illegal Break-In” is preposterous. As is his reference to the Fourth Amendment. One of his incompetent lawyers probably read him part of the Amendment and Trump ran with it. The Fourth Amendment states that…

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue…”

Which is where Trump likely interrupted and demanded that his mangled interpretation of “justice” be sought as he made a “major motion” with his tiny hands to dispatch his lawyers on this fool’s mission. Had he listened to the rest of the Amendment, he would have heard that “no warrants shall issue…”

“…but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Each and every one of those stipulations was met by the FBI in order to get a judge to signoff on the search warrant. Right-wing Republicans like to deceitfully edit the Bill of Rights to make it conform to their warped worldview. That’s why they only recognize the last half of the Second Amendment that says that “the right of the people to keep and bear Arms, shall not be infringed,” while ignoring the first half that species the requirement that it be within “A well regulated Militia”

Trump’s statement also employs his psychotic suggestion that whatever offense he thinks is directed at him, is actually an offense on all Americans. He would be correct if he just added to his argument “all Americans who break the law.” Instead, he tacked on his tedious whimpering about “Witch Hunts” and the long ago debunked lie about spying on his campaign.

It’s astonishing that Trump’s cult followers haven’t gotten tired of his wretched and repetitious rants. He, and they, are stuck in a pathetic replaying of the same ponderous pleadings in a perpetual loop. And they are always about how he is such a victim of nefarious foes that, despite his superior intelligence and strength, he is always losing to. Which is one of the many reasons that he would make a really awful superhero.

UPDATE: It appears that what Trump might be referring to is a motion for the court to appoint a “special master” to review the materials retrieved by the FBI. That is hardly a “major” motion since the FBI is already employing a “filter team” for such reviews, which is essentially the same thing.

Trump Proves His Idiocy (Again): He Thinks Verizon Dropping One America News (OAN) is Illegal

The depth of Donald Trump’s ignorance is impossible to measure. He is the Mariana Trench of stupidity. And yet, he seems perpetually compelled to show off how pitifully feeble-minded he is at every opportunity. He appears to have a perverse pride in being an utter imbecile. Perhaps it makes him feel closer to his dimwitted cult followers.

On Sunday morning Trump posted a comment on his miserably failing social media website, TRUTH Social (that is currently being criminally investigated by a Grand Jury), yowling about the decision by Verizon to drop One America News (OAN), his favorite, ultra-rightist disinformation channel. That decision may be the death knell for OAN who have now lost all but one of their cable outlets.

Naturally, Trump was shocked and outraged that a private company made a rational business decision that conflicted with Trump’s inbred biases and petulant self interests. Especially OAN, that has served as his virtual North Korean style Ministry of Propaganda from its inception. So he raged on his Twitter ripoff site that…

“One America News (OAN) is AMAZING, with great ratings and a REALLY loyal following. Despite it being so good, VERIZON, for purely political reasons, will be terminating OAN at the end of this month. Isn’t this ‘stuff’ supposed to be illegal? The good news is that the owners and management of One America News is smart and very wise. They will figure it out!”

What’s “AMAZING” is how ridiculously foolish Trump can be, and how proud he seems to be of it. Trump’s assertion that OAN has “great ratings” is laughably untrue. Their audience is so small that Nielsen doesn’t even track it. So you have to wonder what “ratings” Trump is referring to. Although Trump may be right about OAN having a loyal following, because that’s what cults do.

Trump goes on to accuse Verizon of ditching OAN for “purely political reasons.” Of course, he doesn’t offer a shred evidence to support that charge. However there is an obvious financial justification for dropping a channel that has a negligible number of viewers. What’s more, OAN is being sued for defamation by the voting software company, Smartmatic. The case revolves around the part OAN has played in promulgating Trump’s “Big Lie” about election fraud. Cable programmers would be wise to distance themselves from such potentially damaging legal exposure.

Finally, Trump asks his TRUTH(less) (Anti)Social followers “Isn’t this ‘stuff’ supposed to be illegal?” Sure, if you live in a totalitarian dictatorship where the media is required to obey the mandates of power mad demagogues. But in a nation where a free press is protected by its Constitution, private companies are permitted to make their own business decisions in the best interest of their shareholders, employees, and customers. In the United States it would, in fact, be illegal for the government to interfere with such decisions.

Trump, however, has always leaned toward tyranny. He prefers a country wherein he is the fuehrer making decisions that only benefit him. He had the same autocratic reaction to OAN being dropped by DirecTV earlier this year. And he couldn’t stop whining about it for months. So strap in. We can expect the same sort of obsessive ravings over the Verizon decision going forward.

Trump Publicly Confesses to Coup Attempt in Tweet that Pence ‘Could Have Overturned the Election’

Throughout most of his life, Donald Trump has bragged about his allegedly superior intellect and judgment. As President he claimed to be a “stable genius” who knows more than generals about war, more than economists about the economy, and more than doctors about healthcare. The American people – according to a Fox News poll – didn’t agree.

However, if anything puts to rest Trump’s terminally narcissistic impression of himself, it is his latest deranged outburst regarding the election that he lost and his efforts to subvert democracy and coronate himself an American king. In a tweet posted by his Twitter ban defying spokes-shill, Trump raged that…

“If the Vice President (Mike Pence) had ‘absolutely no right’ to change the Presidential Election results in the Senate, despite fraud and many other irregularities, how come the Democrats and RINO Republicans, like Wacky Susan Collins, are desperately trying to pass legislation that will not allow the Vice President to change the results of the election? Actually, what they are saying, is that Mike Pence did have the right to change the outcome, and they now want to take that right away. Unfortunately, he didn’t exercise that power, he could have overturned the Election!”

To the surprise of no one, Trump has utterly misunderstood the law and what a bipartisan effort in Congress is engaged in. The fact that members of both parties are joining together to draft a clarification of the Electoral Count Act of 1887 only affirms the broad-based consensus that Trump’s actions have been deemed dangerous and warrant a refinement of the legal language to prevent future misrepresentations of what the law already says. Which is that the vice-president’s role is strictly ceremonial and that he has no power to “change the Presidential Election results” or to “overturn the election.” Furthermore, the 12th Amendment to the Constitution stipulates that the vice-president is only authorized to open the certificates of the votes provided by the states and to announce the results.

What Trump has provided in his statement is a public confession of his conspiracy to stage a coup and to usurp the power of the presidency by unlawful means. It’s a plot that he tried to execute by force with his support for January 6th insurrection and the insurrectionists he said that he loves. He even promised to pardon the domestic terrorists who assaulted Congress, and presumably those who might commit such assaults in the future.

This isn’t the first time that Trump has lied to bully the Vice-President into joining his treasonous plot. In a couple of his last tweets before being banned from Twitter, Trump wrote that “If Vice President @Mike_Pence comes through for us, we will win the Presidency,” and that “The Vice President has the power to reject fraudulently chosen electors.”

None of that is true. And even if it were, Trump hasn’t thought it out very well. His misinterpretation would mean that Vice-President Kamala Harris could decide unilaterally who would become president after the 2024 election, regardless of the vote count. That’s something the “stable genius” failed to consider.

Trump, however, has an even bigger problem. His tweeted statement is yet another affirmation of his participation in an attempted insurrection. And the Constitution – which he certainly has never read – addresses that in Section 3 of the 14th Amendment:

“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

In short, Trump’s confession prohibits him from ever serving in any government office. The Constitution unambiguously bars him from running for, or serving as, president again. And that’s just the beginning of his problems. After spending the last year trying unsuccessfully to suppress his White House documents, he has now provided prosecutors with the final piece of the evidentiary puzzle needed to indict him and his accomplices for his coup attempt and for conspiracy to overthrow the U.S. government. Now it’s just up to the Justice Department to do its job.

UPDATE I: Jen Psaki steps up and condemns Trump “whose actions have represented a unique and existential threat to our democracy,” and are “a reminder of how unfit he is for office.”

UPDATE II: Trump doubles down on his confession. In another tweet he attempts to elaborate on his assertion that Pence had the right to reject the state-certified vote counts. But all Trump is doing is reiterating his intent to illegally overturn the election results, subvert democracy, and violate the Constitution. He’s just getting himself in deeper.
