And the blunder by Trump&#8217;s attorney, Rudy Giuliani, on Thursday is just the latest example of this phenomenon.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.newscorpse.com\/Pix\/Trump\/giuliani-trump-baby.jpg\" alt=\"Rudy Giuliani, Donald Trump\" width=\"550\" height=\"296\" class=\"aligncenter size-full wp-image-37880\" \/><br \/>\n<a href=\"https:\/\/www.facebook.com\/NewsCorpse\/posts\/2264138420267607\" target=\"_blank\" title=\"Share on Facebook\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.newscorpse.com\/Pix\/Advs\/fb-share-tn.jpg\" width=\"274\" height=\"20\" class=\"aligncenter\"\/><\/a><\/p>\n<p>If Saturday Night Live wanted to create a satirical character whose practice of the law incriminated his client more often than not, they would only need to transcribe Giuliani&#8217;s comments verbatim. In this episode, Giuliani attempted to clean up a Trump tweet that appeared to most people as an obvious effort to obstruct justice with regard to the special counsel probe of Robert Mueller. Trump tweeted:<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">..This is a terrible situation and Attorney General Jeff Sessions should stop this Rigged Witch Hunt right now, before it continues to stain our country any further. Bob Mueller is totally conflicted, and his 17 Angry Democrats that are doing his dirty work are a disgrace to USA!<\/p>\n<p>&mdash; Donald J. Trump (@realDonaldTrump) <a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1024646945640525826?ref_src=twsrc%5Etfw\">August 1, 2018<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>That sure looks like Trump is directing his Attorney General to halt the investigation into Trump&#8217;s collusion with Russia. But Giuliani has an alternative interpretation of the tweet that makes it completely innocent. He <strong><a href=\"https:\/\/www.cnn.com\/2018\/08\/01\/politics\/trump-russia-jeff-sessions-mueller\/index.html\" rel=\"noopener\" target=\"_blank\">told CNN&#8217;s Dana Bash<\/a><\/strong> that Trump was just <em>&#8220;expressing his opinion on his favored medium for asserting his First Amendment right of free speech. He said &#8216;should&#8217; not &#8216;must.'&#8221;<\/em><\/p>\n<p>So the use of the word <em>&#8220;should&#8221;<\/em> absolves Trump of any culpability for comments that seem to be giving Sessions a direct order. But if your boss told you that you should stop working on a <em>&#8220;terrible&#8221;<\/em> project <em>&#8220;right now,&#8221;<\/em> would you think he was just expressing an opinion and ignore him? Not if you wanted to keep your job, you wouldn&#8217;t. But if Giuliani is so fixated on the words <em>&#8220;should&#8221;<\/em> and <em>&#8220;must,&#8221;<\/em> then he might want to refer back to this tweet by Trump in April:<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Just Out: House Intelligence Committee Report released. \u201cNo evidence\u201d that the Trump Campaign \u201ccolluded, coordinated or conspired with Russia.\u201d Clinton Campaign paid for Opposition Research obtained from Russia- Wow! A total Witch Hunt! MUST END NOW!<\/p>\n<p>&mdash; Donald J. Trump (@realDonaldTrump) <a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/989870523042680832?ref_src=twsrc%5Etfw\">April 27, 2018<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>That satisfies the Giuliani standard of saying <em>&#8220;must&#8221;<\/em> in order for the directive to be considered obstruction of justice. So we all owe Rudy our thanks for making the legal argument so clear and applicable to his client.
