Liz Cheney: The ‘Supreme Dereliction of Duty’ By Trump Could Warrant Criminal Referral

With the ongoing horrors of the Russian genocide on Ukraine, it’s easy to forget the domestic horrors that are still percolating here at home. Although it’s been more than a year since Donald Trump incited deadly riots in Washington, D.C., the need for accountability has never diminished. Indeed, recent polls show – and Trump bizarrely brags – that 67% of Americans say that Trump is responsible for the violent January 6th insurrection.

The House Select Committee investigating the January 6th insurrection is continuing its exhaustive process of acquiring testimony and documentation of the crimes of Trump and others in his conspiratorial cabal. And Attorney General Merrick Garland said earlier this month that the Justice Department’s investigation won’t end until everyone is held accountable:

“Attorney General Merrick Garland said Thursday that when it comes to politically sensitive investigations, the Justice Department does ‘not shy away from cases that are controversial or sensitive or political. To do that would undermine an element of the rule of law, which is that we treat like cases alike without regard to the subject matter,’ Garland told reporters in response to a question about the January 6 investigation.”

So while it appears that the probe is dragging on interminably, there are also signs that the wheels of justice are turning and that the perpetrators will face consequences. That prospect was addressed during an interview with a Republican Committee member , Liz Cheney, on Meet the Press:

Chuck Todd: Should we expect criminal referrals on this? And should we expect something – how much new do you think the public will learn that will actually change the way they thought about January 6th?

Cheney: I think certainly our first priority is to make recommendations. And we see things like do we need enhanced criminal penalties for the kind of supreme dereliction of duty that you saw with president Trump when he refused to tell the mob to go home after he had provoked that attack on the Capitol.

So there will be legislative recommendations and there certainly will be information. And I can tell you I have not learned a single thing since I have been on this committee that has made me less concerned or less worried about the gravity of the situation and the actions that president Trump took and also refused to take while the attack was underway.

First of all, Todd’s question implies that the public needs to learn something new that will change their minds about Trump’s guilt. And while there’s always room for more, the majority of the American people are already convinced of of his culpability.

More to the point, Cheney’s response reveals that the Committee is collecting abundant evidence that could result in indictments. Her reference to Trump’s “supreme dereliction of duty” was not made casually. And her observance that the more information that comes out, the more Trump’s wrongdoing is apparent, cannot be providing Trump much comfort.

The January 6th Committee has compiled a massive amount of evidence and deposed numerous Trump insiders. They are building a strong case supported by first hand testimony and unimpeachable documentation, including untold hours of damning video. And while the pace is frustratingly slow, the direction is unambiguously toward conviction.

Nevertheless, the public needs to stay alert and continue to put pressure on the legal and political players who control the process. That’s the path to holding Trump and his seditious confederates accountable, and to achieve the righteous goal of justice: Lock Him Up!

Donald Trump Circling the Drain

While the rest of the world is focused on the human tragedy of Russia’s invasion of Ukraine by Trump’s BFF Vladimir Putin – a murderous war criminal with whom Trump is still hopelessly infatuated – Trump is, as usual, fixated on himself and his own personal legal problems. He has hardly said a word about Ukraine, probably because he has no friggin’ idea what to do about it. So instead, he persists in ranting repeatedly about the nonexistent voter fraud in the 2020 presidential election and the civil and criminal investigations into his countless crimes.

On Sunday morning Trump released statements with links to articles that he apparently thinks absolve him of liability for the financial corruption of his failing real estate enterprise. But he totally misunderstood what he read, or more likely, had read to him. Both articles dealt with the recent resignation of two prosecutors from the office of the New York County District Attorney. And both contain extensive affirmation of Trump’s guilt. To be sure, the resignations were a disappointment to people who want to see Trump held to account for his wrongdoing. But Trump’s take on the matter is pitifully mistaken.

In the first tweet Trump linked to a Daily Mail article about the DA’s reluctance to file an indictment. But what Trump ignored in the article is that the prosecutors who resigned did so to “disassociate” from the decision because “it was on the wrong side of history.” Furthermore, the article notes that, despite the resignations, “The investigation is ongoing.” So it is hardly a vindication.

In the second tweet Trump gloms on to a question in the New York Times article asking “Which laws had Mr. Trump broken?” He answers it himself saying “The crime of … making his lenders ‘more’ money.” Then he calls the probe “Sick!” However, his crime has nothing to do with whether the banks he defrauded made any profit. It has to do with the fact that he committed fraud in order to secure the loans. The prosecutor described it as “a righteous case that ought to be brought.” Trump’s tweet quoted from the article…

“For months, the prosecutors had envisioned charging Mr. Trump — and possibly Mr. Weisselberg and the Trump Organization — with the crime of ‘scheming to defraud’ for falsely inflating his assets on the statements of financial condition that had been used to obtain bank loans.

“But by the end of the year, the prosecutors had switched gears, in part because Mr. Trump’s lenders had not lost money on the loans but had in fact profited from them. The new strategy was to charge Mr. Trump with conspiracy and falsifying business records — specifically his financial statements — a simpler case that essentially amounted to painting Mr. Trump as a liar rather than a thief.”

Apparently Trump thinks that being charged with lying rather than stealing is some kind of exoneration. But he’s even got that wrong. Let’s look at what the article is saying. The DA’s charge changed from “‘scheming to defraud’ for falsely inflating his assets,” to “conspiracy and falsifying business records.” That’s a distinction without a difference. Or very little difference. And both are serious felonies for both lying and stealing.

So Trump is celebrating these articles that unambiguously affirm that he’s guilty of fraud and/or conspiracy to commit fraud. This is further evidence of his staggering stupidity. Yet he is so shamelessly boasting about this imaginary absolution that he’s forgotten that he is still under investigation by this DA in Manhattan, as well as the New York Attorney General, the U.S. Attorney in D.C., and the District Attorney of Fulton County, Georgia. That’s a pretty sorry statement about both his legal and mental condition.

Jen Psaki: Biden Will Address Trump’s ‘Singular Responsibility’ for the ‘Chaos and Carnage’ on January 6th

Tomorrow is the one year anniversary of the worst attack on the United States Congress and American democracy in more than 200 years. The insurrection of January 6, 2021, by Donald Trump’s cult disciples was an abhorrent attempt to overthrow our democratic system of government by violence. It was, indisputably, a coup attempt. And it was orchestrated by Trump and his traitorous confederates in politics and the press.

In observance of that nightmarish day, both Congress and the White House have scheduled events to mourn for the victims, honor the heroes, and memorialize this chilling episode of our national history. As a preview of the proceedings, White House Press Secretary Jen Psaki provided a brief summary of what President Biden will say in his remarks. Her description of the President’s address should give hope to the nation that the crimes of the last administration will not go unpunished (video below):

“The President is going to speak to the truth of what happened – not the lies that some have spread since – and the peril posed to the rule of law and our system of democratic governance. He will also speak to the work we still need to do to secure and strengthen our democracy and our institutions; to reject the hatred and lies we saw on January 6th; and to unite our country. I’d also note that President Biden has been clear eyed about the threat the former president represents and how the former president constantly works to undermine basic American values and rule of law.

“President Biden has, of course, spoken repeatedly about how the former president has abused his office, undermined the Constitution, and ignored his oath to the American people in an effort to amass more power for himself and his allies. He sees January 6th as a tragic culmination of what those four years under president Trump did to our country. And they reflected the importance to the President of winning the battle for the soul of our nation.

“So just as you heard him say on January 6th of last year, I would expect that President Biden will lay out the significance of what happened at the Capitol, and the singular responsibility president Trump has for the chaos and carnage that we saw. And he will forcibly push back on the lies spread by the former president in an attempt to mislead the American people and his own supporters, as well as distract from his role in what happened. He will, of course speak to the moment, to the importance in history of the peaceful transfer of power, of what we need to do to protect our own democracy and be forward looking. But he will also reflect on the role his predecessor had.”

If Biden lives up to this preview, the country can be proud and satisfied that the perpetrators of the insurrection – including Trump – will be brought to justice. But if justice is not served, the insurrection last year will just have been a trial run. Time will tell.

It’s notable that Trump had scheduled a competing public event for the anniversary. He announced that he would stage a “news” conference to further disseminate his flagrant falsehoods. However, he subsequently chickened out and canceled that affair after revelations about how Sean Hannity had been involved with the Trump White House during the riots. But that won’t end Trump’s campaign of lies. So continued vigilance will be required to preserve American democracy.

NY Attorney General Letitia James Replies to Trump’s Ludicrous and Fear Driven Lawsuit

The former reality TV game show host and aspiring authoritarian dictator, Donald Trump, seems intent on advertising to the world just how frightened he is of his future that is filled with legal jeopardy and multiple civil and criminal prosecutions. He demonstrated that fear on Saturday by whining petulantly about Democrats as “vicious, violent, and Radical Left thugs” because “All the Democrats want to do is put people in jail.”

Trump is right, sort of. Democrats do want to put people who have committed crimes in jail. And that’s precisely what Trump is so worried about. He knows what he’s done. Consequently, he is now escalating his war on justice with a preposterous lawsuit against New York Attorney General Letitia James. Trump was brought to this panicky point because James is investigating the well documented corruption of his real estate business. In his complaint, Trump asserts that…

“The investigations commenced by James are in no way connected to legitimate law enforcement goals, but rather, are merely a thinly-veiled effort to publicly malign Trump and his associates. Her mission is guided solely by political animus and a desire to harass, intimidate, and retaliate against a private citizen who she views as a political opponent.”

Trump’s suit seeks to prohibit the Attorney General from conducting investigations and taking part in any legal actions against him or his crime syndicate. He further alleges that James is engaging in an attempt to undermine him politically and violate his constitutional rights. As usual, he doesn’t bother to present any evidence to support his absurd and vengeance-driven allegations. What he does is release a statement (via his Twitter ban defying spokes-shill) that is overtly threatening:

“Tell Letitia that she is not dealing with the Cuomo brothers, a corrupt Governor in a corrupt state, including your office and others, and Fredo, who did the Governor’s dirty work for him.”

Trump’s statement went on to brag that he endured “many years of investigation that nobody else could have survived.” He must have forgotten that he was impeached twice; his phony “university” was found guilty of fraud and forced to pay out $25 million to his victims; his crooked “charity” was shuttered and he and his family strictly constrained in running any other non-profit in New York for five years. And there is still pending litigation against him by women alleging that he sexually harassed and/or assaulted them.

Nevertheless, Trump is predictably calling the investigation in New York a (what else) “Witch Hunt.” Then he lashes out personally at James saying that she “should not be in office,” and that her decision not to run for governor (so that she could concentrate on the Trump case) indicated that the people of New York rejected her. But Trump’s impotent insult ignores that fact that James is still popular and is expected to win her reelection campaign for Attorney General.

James issued a brief reply to Trump’s Monday morning tirade:

“The Trump Organization has continually sought to delay our investigation into its business dealings and now Donald Trump and his namesake company have filed a lawsuit as an attempted collateral attack on that investigation. To be clear, neither Mr. Trump nor the Trump Organization get to dictate if and where they will answer for their actions. Our investigation will continue undeterred because no one is above the law, not even someone with the name Trump.”

So Trump’s attempt to bully James utterly failed to intimidated her. His pathetic lawsuit is likely to be laughed out of court. And the other pending cases against him will go forward as well. Trump will have to sit for depositions, which are likely to result in new charges of perjury when he invariably lies. And he will continue to whine until he manages to hire a competent attorney who isn’t afraid to tell him to shut up. But don’t hold your breath on that one.

Poor Baby Trump is Scared Witless of Being Held Legally Accountable for His Many Crimes

It’s always easy to tell what is bothering Donald Trump most. His emotionally stunted, childish behavior gives him away every time. Whatever he is whining about with the greatest fury is what is gnawing at his fragile ego, and he will unfailingly throw a public tantrum over it. After all, Trump, in his own words, described himself as the most fabulous whiner.”

On Saturday Trump unleashed another of his histrionic harangues. This one, like many before it, was almost entirely devoid of substance. He doesn’t bother to explain the reasons for his irrational hysteria. He merely opens his douchenozzle and lets it spray. But it invariably comes out like an impotent drip that couldn’t dampen an already used Kleenex.

On this occasion Trump’s message was posted in a frantic tweet by (his Twitter ban defying spokes-shill):

“All the Democrats want to do is put people in jail. They are vicious, violent, and Radical Left thugs. They are destroying people’s lives, which is the only thing they are good at. They couldn’t get out of Afghanistan without disgracing our Country. The economy and inflation are a disaster. They’re letting thugs and murderers into our Country—their DA’s, AG’s, and Dem Law Enforcement are out of control. This is what happens in communist countries and dictatorships, and they don’t think they’ll be held accountable for rigging the 2020 Presidential Election. The Jan. 6 Unselect Committee is a coverup for what took place on November 3rd, and the people of our Country won’t stand for it.”

Let’s unpack this pile of pomposity. Trump begins by complaining that Democrats want to “put people in jail.” That’s true, as far as it goes. More specifically, Democrats want to put criminals in jail. And that’s what Trump is afraid of. He knows that he’s guilty of an avalanche of atrocities. And evidence keeps coming out that is likely to result in his indictment and prosecution. His flunkies on Fox News were just exposed for having communicated with him during the January 6th insurrection that he incited. A federal appeals court just ruled that his White House records must be turned over to congressional investigating committees. And he is bitching to Fox News that he doesn’t have anything to hide while he is suing to hide everything.

Naturally, Trump lashes out at Democrats as “vicious, violent, and Radical Left thugs,” because he doesn’t know how to react coherently to the well founded allegations against him. So instead, he rattles off a bunch of lies about Democrats “disgracing” the country or mismanaging the economy. In reality, America is in the midst of a Biden Boom.”

Eventually Trump gets to what is really triggering his tirade. Which is his mortal fear of prosecution and prison. He calls out the “DA’s, AG’s, and Dem Law Enforcement” that he says are “out of control.” Of course, what irks him is that they are out of his control. Indeed, it has just been reported that some of his closest confederates, including Roger Stone and Steve Bannon, are being threatened with contempt of Congress charges for refusing to comply with subpoenas. Stone, and attorneys Jeffrey Clark and John Eastman, have already pleaded the Fifth Amendment to avoid incriminating themselves (and Trump). Which is ironic since Trump famously declared that “the mob takes the Fifth. If you’re innocent why are you taking the Fifth Amendment?”

Trump suspects that prosecutors are getting closer to indicting him. And he isn’t the only one. So he is engaging in a first strike strategy in a futile attempt to tarnish their reputations. And in his customary practice of “projection,” Trump absurdly accuses American district attorneys and attorneys general of being “communists,” a word whose meaning he couldn’t define if his life depended on it.

Finally, Trump reprises his favorite delusion, the alleged the “rigging the 2020 Presidential Election.” Never mind that after a year, and more than 60 court cases, he has failed to produce a shred of evidence. So he employs infantile insults such as calling the House Select Committee investigating the insurrection the “Unselect Committee.” And he continues to undermine American democracy by claiming that the November 3rd election was the “real” insurrection.

This is the whimpering of a frightened con man who feels the heat closing in on him. He couldn’t be more obvious. But he has a right a to be concerned. His crimes are well documented. And hopefully his worries will prove to have been warranted when he is frog-marched in to the police station to be booked.

UPDATE: As further evidence of Trump’s seething fear, he just announced that he has filed a preposterous lawsuit against New York Attorney General Letitia James to try to stop his prosecution. Expect that to be dismissed shortly.

Sen. Grassley Stands Up for Trump’s Right to Conspire to Stage a Coup with DOJ Staff

The evidence that Donald Trump was – and still is – engaged in a treasonous plot to overturn the 2020 presidential election continues to pour in. Recent reports reveal his attempts to pressure the acting Attorney General, Jeffrey Rosen, to “just say that the election was corrupt + leave the rest to me and the R. Congressmen.” Trump has not disputed these accounts.

The newly impaneled House Select Committee investigating the January 6th insurrection just interviewed Rosen and, while the details have not been made public, there is general information that has been disclosed, and which are cause for serious concern. However, that concern is apparently not shared by Sen. Chuck Grassley, the ranking Republican member of the Senate Judiciary Committee. Instead, what Grassley was concerned with was that…

“This country has had to deal with Democrats’ obsession with destroying Trump for much too long. In the process I fear my colleagues on the other side of the aisle have done, and will do, lasting damage to our political system.”

If the Democrats are “obsessed” with anything, it’s the preservation of American democracy. And if anyone is doing “lasting damage to the political process,” it’s Donald Trump, who has become, in the words of Carl Bernstein, an American war criminal.” But that isn’t exactly how Grassley sees it. He went on to say that…

“The president has every right to discuss ideas and strategies with his closest advisors. The president, whether that president is Democrat or Republican, should feel unrestrained to bring ideas to his closest staff for robust discussion. Eventually the facts will come out and Trump will have to address them. Good or bad, depending on the facts at hand.

“However, the essential question that should be asked: What was the final decision? And that is my major concern about the recent public comments coming out of these interviews I’ve discussed relating to this new Trump investigation. Unlike my Democratic colleagues, I won’t discuss the evidence publicly at this point in time. But let me remind the American public with a couple already public points. Did Trump fire acting Attorney General Jeffrey Rosen? No, he did not fire him.”

To be clear, Grassley is making the case that the president has the right to conspire against the United States of America, and to that end, he must be free to discuss “ideas and strategies” for staging a coup to seize power. Really? Perhaps the ranking Republican member of the Judiciary Committee should peruse the U.S. Constitution. Because what he’s suggesting is a flagrant breach of the supreme law of the land.

What’s more, the “essential question” is certainly not “What was the final decision?” No more than that would be the essential question in a case of conspiracy to rob a bank. The conspiracy is unlawful in and of itself. And Trump’s decision not to fire Rosen only came about when he was confronted by the threat of mass resignations by Justice Department officials. Trump didn’t have pangs of conscience that led him to do the right thing. He had a stabbing fear that his exploits would lead to a “Saturday Night Massacre” moment and he would suffer the same fate that Richard Nixon did.

For Grassley utter these words on the Senate floor without any sense of shame is illustrative of just how far down the rabid hole he has sunk. And like most of the rest of the Republican Party, he is nothing more than a Trump flunky serving Dear Leader and ignoring the welfare – and the laws – of the nation. For that reason, the American people need to stay active and engaged and determined to vote out every Republican on the ballot in 2022. The stakes are too high to get complacent or apathetic. Not with people like Grassley in high positions of power.

Wannabe Dictator Trump Admits to Pressuring DOJ to ‘Just Say the Election Was Corrupt’

It isn’t often that a criminal under investigation for serious felonies makes public statements attesting to his guilt. That would be extraordinarily stupid, as well as an indication of a psychotic degree of arrogance and narcissism. So naturally, that’s precisely what Donald Trump has done in an astonishing statement that affirms his treasonous abuse of power.

Trump’s spokes-shill, Liz Harrington, released Trump’s statement in a tweet (a flagrant violation of Twitter’s Terms of Service that prohibit circumventing a ban). In the statement Trump was reacting to the recent revelation that he pressured the Department of Justice and his Acting Attorney General, Jeffrey Rosen, to “just say that the election was corrupt + leave the rest to me and the R. Congressmen.”

Notice that Trump was not asking the DOJ to establish a factual basis for saying the election was corrupt. He just wanted them to say it, despite a total lack of evidence. Then he and his fellow coup plotters in Congress (allegedly Jim Jordan and Ron Johnson) would take it from there.

More troubling is the fact that Trump’s statement didn’t deny any of the allegations. To the contrary, he affirmed that he had these wholly improper discussions with the DOJ, who told him that “much of the info you’re getting is false,” and that they “look[ed] at allegations but they do not pan out.” Undeterred, Trump persisted claiming bizarrely that “You guys may not be following the internet the way I do,” as if that admission of idiocy validated his “Big Lie.” Trump’s statement raged that…

“The corrupt and highly partisan House Democrats who run the House Oversight Committee yesterday released documents – including court findings dealing with the rigged election of 2020 – that they dishonestly described as attempting to overturn the election.

“In fact it was just the opposite. The documents were meant to uphold the integrity and honesty of elections and the sanctity of our vote. The American people want, and demand, the the President of the United States, it’s chief law enforcement officer in the country, stand with them to fight for Election Integrity and to investigate attempts to undermine our nation. Our country has just suffered an incredibly corrupt Presidential Election, and it is time for Congress and others to investigate how such corruption was allowed to take place rather than investigating those that are exposing this massive fraud on the American people.”

So Trump doesn’t dispute any of the substance of the documents that were released. He merely provides his own utterly irrational interpretation of their meaning. Fine. People – and juries – can judge for themselves what his own Justice officials were saying when he sought to coerce them into making deliberately false comments about the election. The DOJ’s contemporaneous notes, and their outright refusal to follow his orders, make clear that they didn’t accept his fictional and self-serving version of events.

Trump’s call for an investigation is laughable considering that he has already lost more than sixty court cases due to lack of evidence. Many of those cases were before judges that he appointed, including the Supreme Court. But if he wants Congress to probe the “massive fraud on the American people,” he should commit to voluntarily providing testimony under oath himself. Yeah, that’ll happen. However, he may not like the results when he is found to be responsible for the fraud, along with his Republican confederates, Fox News, and the rest of the decaying Trump Cult.

CNN’s ‘Untouchable’ Jim Acosta: ‘What Are You Prepared To Do’ to Hold Trump Accountable?

The descent into authoritarian madness by Donald Trump remains a palpable threat to American democracy. With each new day he escalates his baseless allegations of a “stolen” election. And he does this with the full knowledge that his lies incited violent riots in Washington, D.C., by his insurrectionist cult followers. He does this with the full knowledge that his continuing lies will likely fuel more violence. Which is just what this maniac wants.

Much has been said about how to respond to Trump’s persistent assault on democracy. People talk about indictments, legislation, and organizing to elect honorable representatives in Congress who will take their oath of office seriously. But this is an “all of the above” situation. It all comes down to one question. A question that probes the level of commitment that we have to preserve our republic. That question was asked on Saturday by CNN anchor Jim Acosta, after playing a particularly cringeworthy clip of Trump conceding his vile, aberrant character, or lack thereof:

Trump: I didn’t become different. I got impeached twice. I didn’t change. I became worse.
Acosta: I, for one, believe him. He has become worse, if that’s possible. The current President says American democracy is still being threatened. Yes, it is being threatened, by the former guy.

“As Jim Malone would ask, What are you prepared to do?’ What is law enforcement prepared to about Trump’s actions surrounding January 6th? What are Democrats prepared to do to protect our elections? What are you, the voter, prepared to do to hold accountable those politicians who choose Trump over American democracy? What are you prepared to do?

Acosta was channeling Jim Malone, the character played by Sean Connery in “The Untouchables.” FBI agent Eliot Ness sought out Malone’s advice on how to get Al Capone. Malone responded…

“You said you wanted to know how to get Capone. Do you really want to get him? … What are you prepared to do?”

Ness, of course, replied that he would do everything within the law. And that must be what American patriots pledge to do with regard to Trump. That must be what politicians – Democrats and Republicans – commit to. It must be the course that law enforcement and Justice Department prosecutors take without fear or prejudice.

Without accountability, the criminal acts of Trump will be swept aside, and future aspiring dictators will pursue the same paths of tyranny. However, Trump’s more savvy successors will have the benefit of learning from his failures and foolishness. They are already on that path as Republicans in many states are passing voter suppression bills and legislation giving partisan autocrats the right to overturn the will of the people.

For this reason we need to take Acosta’s adaptation of Malone’s question to heart. That scene led to the infamous exchange where in Malone advised Ness that if…

“You want to get Capone? Here’s how you get him. He pulls a knife? You pull a gun. He sends one of yours to the hospital? You send one of his to the morgue! That’s the Chicago way, and that’s how you get Capone! Now, do you want to do that? Are you ready to do that?”

Of course that’s metaphorical in this context. But Acosta is providing just the sort of inspiration that is needed at this perilous junction in American history. We need to have that kind of devotion to political victory on behalf of democratic values. It will take great effort sustained for many months and years. Are you ready to do that? For America’s sake, I hope so.

Rudy Giuliani Weaves an Absolutely Loony Tale of His Encounter with the FBI

On Wednesday the FBI executed a search warrant at the home and office of Donald Trump’s personal attorney, Rudy Giuliani. It was, according to Giuliani, a travesty on the part of the Biden Vindictive government,” despite the fact that the investigation was launched by Bill Barr’s Justice Department when Trump was still in the White House.

On Thursday Giuliani visited Fox News in an attempt to extricate himself from the web of deceit he was trapped in due to his own shady dealings. He was “interviewed” by Tucker Carlson, the host who Fox News successfully argued in court could not be taken seriously. That was his first mistake. During this segment Giuliani recited his version of what took place when the feds came to his door. It’s pretty pathetic script that fails to make any sense or advance his interests. He began by constructing a thoroughly unbelievable exchange involving hard drives that he said belonged to Hunter Biden. Here is how he described the encounter:

Giuliani: ‘Don’t you want these?
FBI: What are they?
Giuliani: Those are Hunter Biden’s hard drives.
FBI: No, no, no, no!’
Giuliani: Are you sure you don’t want them? The warrant required them to take it.
FBI: No, no!
Giuliani: Don’t you think you should take it.
FBI: No!

Think about how preposterously unlikely all of that is. First of all, Giuliani wants us to believe that he was in possession of Hunter Biden’s hard drives and that he did nothing with them for two years, even though he was obsessed with destroying the Bidens. Then the FBI raids his home and he’s suddenly anxious to give them away to agents that he believes are hostile and intent on persecuting him. If there was anything incriminating on those hard drives, wouldn’t Giuliani want to retain possession of them?

Secondly, why would the FBI refuse to take these hard drives? Giuliani is insinuating that the agents are operatives of the “Deep State” who want to cover for the Biden family. So wouldn’t taking the drives serve that purpose? It would remove them from Giuliani’s custody and allow them to “lose” the alleged evidence, if that were actually their goal.

Thirdly, Giuliani’s telling of this encounter suggests that the FBI agents vehemently and repeatedly refused to take the hard drives. Are we supposed to believe that just being near the hard drives made the agents visibly nervous, and that they would expose their anxieties to the subject of their investigation?

Giuliani went on to claim that the agents were “required” to take the alleged hard drives. That’s false. They have discretion to take only what they consider to be relevant to the investigation. Giuliani also wondered why the agents would take his word for what the hard drives contained, saying that “They could have been Donald Trump’s. They could have been Vladimir Putin’s.” What exactly is he implying, and does he really want to go there? By the same token, Giuliani is asking us to take his word that any of this happened at all.

Finally, Giuliani’s claim that the evidence seized would be “exculpatory” isn’t in the remotest sense plausible. If it were true, then why would he be upset about having been served the warrant? He should be pleased that he’s about to be exonerated. Clearly his simmering panic indicates that he knows he is in legal peril.

Giuliani’s appearance on Fox News demonstrates precisely why credible lawyers don’t want their clients talking on television. Even when they they think they are among friends. In fact, being with Tucker Carlson makes it more likely that Giuliani would feel at ease and, thus, susceptible to letting something slip that is incriminating.

As a lawyer, you might think that Giuliani would know this. But as an idiot who has lost some sixty cases related to election fraud on Trump’s behalf, he has proven that he doesn’t have a clue. And he’s still Trump’s lawyer, which should make all the prosecutors investigating him very happy.

Fox News Hacks Tucker Carlson and Jeanine Pirro Really Don’t Get the Supreme Court

President Biden’s quiet competence and managerial success is befuddling his critics among the press and partisan Republican politicians. Consequently, they continue to have so little to do that they are making up pseudo-controversies to pass the time. It’s really pretty pathetic.

Their desperation has lead to tawdry displays of hostility related to relative trivialities. If they aren’t “canceling” their former Big Business allies, they are whining that Biden is neglecting such vital presidential duties as tweeting and yakking with cable news bootlickers.

Speaking of cable news bootlickers, the variety that has been polishing Donald Trump’s Tecovas, Fox News, is presently aghast at the thought of Democrats exploring the possibility of expanding the Supreme Court. A bill just introduced in the House suggests an increase from nine to thirteen justices.

There are plenty of rational arguments pro and con for this initiative but, somehow, the blowhards on Fox News evaded anything remotely resembling rationality. Tucker Carlson invited his Fox colleague “Judge” Jeanine Pirro on his program to mangle the issue beyond recognition (video below). The segment established with certainty that neither have any idea what the Supreme Court is. Pirro began by ranting that…

“This will change the United States dramatically. The left will have the ability to have in court – which is essentially nothing more than a legislative leaning body – that will approve of all of the issues that they are trying to make across the board in the United States. We will no longer have a Supreme Court that is based on the number of justices depending on who the president is. And it will all be leaning toward the person who is in office and who has the power. This is madness! It’s madness! As if the country isn’t lost enough.”

It truly is madness that Pirro thinks the Supreme Court isn’t already – and always has been – an institution significantly influenced by politics. That’s by design. The Constitution gave the power to nominate justices to the president and the responsibility of confirmation to the Senate. Both of which are political entities. However, she goes way too far to insist that the Court is just a legislative body. It absolutely is not. It has no power to draft legislation. It’s role is to ascertain whether laws, or specific applications of them, are consistent with congressional intent and the Constitution.

Pirro further misses the mark by claiming that an expanded Court unfairly serves one side of the political divide. In fact, it would be less likely to because there would be more diversity of opinion. Although the Court would still, contrary to Pirro’s musings, be made up of justices appointed by whoever is president. Where on Earth does she get the notion that that would change?

For his part, Carlson agrees with Pirro’s badly warped misinterpretations. He accuses Democratic proponents of expansion of saying “No more pretense. It’s purely a political body that rubber stamps our agenda.” And that’s different than the current Court, how? He claimed that an expanded Court would no longer be impartial, or be viewed that way. By whom? If he isn’t aware that the current justices aren’t already viewed as beholden to the political ideologies of the presidents who appointed them, he must be near comatose. Which leads to Pirro’s elaboration on her prior comments saying that “the people who are in power…”

“…are determined to make sure that their agenda is passed because you’ve got the president, and you’ve got the Congress, and now you’ve got the Supreme Court. […] We will lose our respect for that court as nothing more than a political legislative body. An imprimatur, if you will, for the Democrats.”

Really? And what does she think the present Court is “an imprimatur” for? She must know that Justice Gorsuch was only confirmed because Republicans in the Senate refused to consider an Obama nominee (Merrick Garland) for a year in order to give that nomination to the next president who they hoped would be a Republican (It was worse. It was Donald Trump). She must also know that Justice Kavanaugh was rammed through the Senate despite credible allegations that he was a boozing, sexual predator. She must also know that Justice Barrett was confirmed even though the opening she filled became available shortly before an election, which was the reason Republicans gave for not confirming Garland. Does she think that the present Court is well respected by most Americans? Carlson doesn’t think so. He closed the segment by lamenting that Democrats…

“…don’t care what you think. Which is not the way we think of democracy. In a democracy our leaders care what we think, by definition.”

If acting in a manner consistent with what the people want is how you show that you care what people think, then Carlson should be supporting the broadly popular President Biden. He should have supported the COVID relief and stimulus bill. He should be supporting the jobs and infrastructure bill. And he shouldn’t be feigning outrage over a proposal to expand the Court simply because Democrats – who the people elected – would have the first shot at nominating the new justices.

It is Carlson and Pirro who are the ones abandoning any pretense of impartiality in favor of being purely political. And they are doing it in such a way as to demonstrate their ignorance of democracy and the role of the Supreme Court. But would you expect any less of them, or of anyone else at Fox News?
