CONGRATULATIONS: Fox News Wins The Most Asinine Conspiracy Theory Promotion Award Of 2013

In these turbulent times there is no shortage of ridiculous nonsense disseminated from right-wing nutcases. We’ve seen relentless challenges to President Obama’s citizenship. We’ve seen Republicans explain how women’s bodies can magically “shut down” pregnancy following a rape. We’ve seen imaginary “death panels” appear in health care legislation. We’ve even seen, courtesy of Glenn Beck, allegations that Obama is protecting the “real” Boston marathon bombers.

How can you possibly top these five-star delusional classics? Well, for Fox News the answer is to pluck a video from the diseased mind of American Family Association director, Bryan Fischer, who thinks that Obama was photoshopped into the Situation Room photo on the day of the raid on Osama Bin Laden. (Video below)

Fischer is well known among crackpot political analysts for sermons just like this one. His reasoning is notoriously flawed. He asserts that Obama didn’t want to be anywhere near the Situation Room during the raid in case it went terribly wrong. But how would it have been beneficial if news of a failed raid was accompanied by reports that Obama neglected to attend the planning? He would have been excoriated for his absence.

What’s more, if Obama were intent on falsifying a photograph after the fact in order to create a scenario more favorable to himself, it would have been much easier to attend the meeting and have himself photoshopped out later, if he thought that was better for his image. And Fischer complains that the picture was cheaply done and obviously faked, suggesting that the White House doesn’t have the wherewithal to employ skilled graphic artists. And finally, we are talking about the friggin President of the United States (aka Leader of the Free World). If he wanted to, he could have ordered everyone back into the room and taken a new photograph.

Absolutely none of what Fischer is alleging makes the least bit of sense to anyone with a functioning brain. Yet, for some reason, Fox News saw fit to promote Fischer’s lunatic lecture on their community web site Fox Nation. This is pretty standard fare for the Fox Nationalists who work diligently to produce the most dishonest content on the Internet.

Rupert Murdoch Fears That Bribery/Hacking Investigation Could “Kill The Corporation”

Rupert MurdochThe Independent is reporting that Rupert Murdoch’s News Corp is under investigation as a “corporate suspect” over the charges that the company engaged in unlawful activities including bribery and hacking the phones, email, and computers of hundreds of politicians, celebrities and private citizens, including a missing schoolgirl who later turned up dead. The inquiry could have significant consequences for News Corp around the world including here in the U.S.

“The Independent has learnt the Metropolitan Police has opened an “active investigation” into the corporate liabilities of the UK newspaper group – recently rebranded News UK – which could have serious implications for the ability of its parent company News Corp to operate in the United States.”

That is not merely the opinion of the investigators and/or reporters. News Corp responded to the inquiry with an apocalyptic warning suggesting that thousands of innocents would suffer if the company were held responsible for its criminal behavior.

“A News Corp analysis of the effects of a corporate charge, produced in New York, said the consequences could ‘kill the corporation and 46,000 jobs would be in jeopardy’.

“Lawyers for the media behemoth have pleaded with the Met[tropolitan Police] and the Crown Prosecution Service not to prosecute the company as it would not be in the ‘public interest’ to put thousands of jobs at risk.”

This attempt to turn employees into human shields notwithstanding, it would be unconscionable for the legal authorities to dismiss crimes because of potential adverse business results asserted by the criminal. That’s kind of like a bank president found guilty of embezzlement asking that his charges be dropped because the bad publicity might hurt the bank.

What’s more, there need not be a single job placed in jeopardy if the corporate offenders were brought to justice, removed from the company, and a properly instituted board of directors (e.g. one not beholden to the Murdoch regime) reformed the management and operations of the enterprise.

News Corp is, and has been, a criminal organization for many years. They are unapologetic about their abuse of the law and the public trust. It is encouraging that the British legal system is pursuing these charges, although in the past they have caved in to pressure from powerful business interests and retreated from doing the right thing. Time will tell if they have the integrity and fortitude to follow through on this matter.

As an addendum, the Independent’s article included an interesting explanation of the U.K.’s legal procedures regarding corporate suspects:

The Crown Prosecution Service can treat a company as a “legal person” who is “capable of being prosecuted”.

Any organisation at the centre of a criminal investigation “should not be treated differently from an individual because of its artificial personality”, according to the CPS.

The latest guidelines state: “A thorough enforcement of the criminal law against corporate offenders, where appropriate, will have a deterrent effect, protect the public and support ethical business practices.

“Prosecuting corporations, where appropriate, will capture the full range of criminality involved and thus lead to increased public confidence in the criminal justice system.”

The U.S. would do well to emulate this, particularly in the wake of the abhorrent Supreme Court decisions defining corporations as persons, but not providing any of the legal accountability to which actual persons are subjected.

RNC Votes To Ban CNN/MSNBC Debates – Which They Have No Power To Do

For the past couple of weeks there has been a flurry of fretful reporting about a threat by Republican National Committee chair Reince Priebus to ban CNN and MSNBC from the GOP primary debate schedule. Priebus is disturbed by currently non-existent projects about Hillary Clinton that he is certain will characterize her favorably.

Today Priebus made good on his threat by shepherding a resolution though the RNC’s annual meeting that declares that they “will neither partner with these networks in the 2016 presidential primary debates nor sanction any primary debates they sponsor.”

Fun Fact: How many GOP primary debates did the RNC sponsor in 2012?
Answer: Zero
There were twenty debates held and not a single one was sponsored by the RNC. However, every debate on Fox News was sponsored by a state Republican Party affiliate. Also notable is that MSNBC held a debate co-sponsored by the Reagan Library, and CNN held debates co-sponsored by Tea Party Express, the Heritage Foundation, and the American Enterprise Institute.

There is, however, a small problem with the Priebus declaration. The RNC has no power whatsoever to prohibit any debate by an network. Sure, they can pass resolutions that make grandiose claims to authority that they don’t have, but reality trumps their hubris. The truth is that any network can announce its intention to produce a debate. They can invite candidates to participate. The candidates are free to accept or reject any offer as they see fit. Chances are, the second and third tier candidates will accept virtually any opportunity to promote themselves on national television. Subsequently, the frontrunners will be reluctant to let their competitors have the stage to themselves. So the debates will go on with a full cast of characters.

Priebus’ threat, therefore, is an impotent cry for attention. He is not empowered to force his will on the people who are vying to be the next leader of the free world. In a best case scenario he may be able to influence the number of debates, which is a goal he has previously articulated. After all, it is fairly obvious that the more Republican candidates are exposed to the American people, the more they will embarrass themselves, and the more votes they will lose. The GOP has a distinct interest in limiting their exposure, and that is what Priebus is aiming for.

The hypocrisy of Priebus’ resolution is apparent in the fact that he is only nixing CNN and MSNBC, even though there have been reports that Fox may be producing the NBC project. Priebus cannot extend his toothless ban to Fox or there would be no cable news networks available to host a GOP debate. But there is no reasonable explanation for why Fox would be given a pass (other than their role as the GOP PR division).

The full text of the resolution cites campaign donations by the head of NBC’s entertainment division to Hillary Clinton, but the head of Fox News’ parent corporation has done likewise. Also, the News Corp political PAC, News America Holdings, has given more to Democrats than Republicans in each of the last four election cycles. So if producing Clinton documentaries and donating to her campaign warrant prohibition as debate hosts, then Fox clearly qualifies.

Rush Limbaugh

Finally, there have been recent calls for the RNC to recruit right-wing loyalists as moderators for their debates. The names mentioned most frequently include Rush Limbaugh, Sean Hannity, and Mark Levin. In response, Levin has said that he is ready and willing, despite the fact that he has previously said that he will do whatever he can to prevent Chris Christie from becoming the GOP nominee. As for Limbaugh, he told his radio dittoheads that he is “too famous” and would “overshadow” the candidates. That’s a telling remark in itself, as it demonstrates just how diminutive is the stature of the GOP field. Perhaps the GOP should nominate Limbaugh.

This tussle could not be better for Hillary Clinton and the Democratic Party. If the RNC is successful in limiting the number of their debates it will have effectively cut off millions of Americans from learning about their candidates (although, as noted above, that might a good thing for the GOP). But even worse is the prospect of debates led by staunchly conservative radio talk show hosts. Priebus and company think that friendly moderators will help avoid the antagonistic questioning that he presumes would occur on other networks. But to the extent that that is true, it will also result in the candidates being woefully unprepared for the full-contact combat they will eventually encounter in the general election. What’s more, the rightist Taliban, as represented by Limbaugh et al, will be more likely to force candidates to stake out extreme positions which they will be unable to “Etch-a-Sketch” away after the primaries. The wingnut media are notoriously committed to the sort of ideological purity that voters find repugnant.

So if the RNC wants to proceed with this self-defeating initiative, they will have the full support and cooperation of their pals at the DNC. Nothing would please Democrats more than Republicans digging themselves ever deeper holes of extremism. The outrageous statements and gaffes that occur at the “official” RNC events would still be broadcast on the other networks afterwards. So Priebus’ efforts to limit the damage would be futile, and even counterproductive. As would his admonition that disobedience “may include severe penalties for candidates that participate in unsanctioned debates.” That’s right – Priebus plans on giving the reprobates a good spanking. Wouldn’t that look great on a candidates permanent record?

IMPEACH, IMPEACH: A Frenzy Breaks Out At Fox News

Is it a slow news day, or just another day at Fox News? For some reason Fox is exposing their wacko side (again) over at their community web site Fox Nation (See Fox Nation vs. Reality for an in-depth look at the site’s blatant dishonesty). In two days they have posted two articles about fishy fringe groups proposing phony “Articles of Impeachment” against President Obama.

The first thing to note is that such articles cannot be drafted by citizens. It is a legal process that begins in the House of Representatives. So these charades have no meaning other than as political publicity stunts. Secondly, the allegations must assert criminal wrongdoing that amount to “high crimes and misdemeanors.” Being unsatisfied with explanations about what took place at Benghazi, or opposition to a health insurance law, that was passed by congress and upheld by the Supreme Court, do not rise to that standard.

Nevertheless, Fox News is going all out to promote these absurd spectacles. The first was posted yesterday with a headline that shouted “Black Citizens Group Files ‘Articles of Impeachment’ Against Obama”

In fact, the group was actually the National Black Republican Association, a shadowy organization with no visible means of support who exist primarily to advance false claims about the historical relationship of Democrats and Republicans to the black community. For instance, they produced radio ads and billboards declaring that Martin Luther King was a Republican, a claim that is demonstrably untrue.

The Fox Nationalists sourced their story to Watchdog.org, a division of the Franklin Center which is financed by the Koch brothers as an “investigative” journalism service. Both Watchdog and the Franklin Center espouse rabidly right-wing/Tea Party propaganda disguised as news reporting – much like Fox News.

The next impeachment article was posted today in the form of a video “trailer” for a new book by noted birther Aaron Klein. The book is titled “Impeachable Offenses: The Case for Removing Barack Oabam from Office.” It suffers from the same deficiencies of law and logic as the NBRA’s article.

Klein’s book was published by the book division of WorldNetDaily, the far-right home of the wildest conspiracy theories on the net, many of which are manufactured by Klein himself. In addition to a variety of birther myths, WorldNetDaily is the source of such reputable reporting as terrorists building “boob” bombs (seriously, you have to see the graphic), and Obama using the movie “The Butler” to incite race wars. The site features such distinguished contributors as Ted Nugent, Victoria Jackson, and Donald Trump.

So that’s two articles in two days planting the asinine idea of impeachment in the minds of Fox’s gullible and glassy-eyed audience. Both are from sources that represent the dregs of the uber-rightist conspiracy swamps with no credibility whatsoever. I can’t wait to see what the Fox Nationalists post tomorrow. And Fox wants people to regard them as a reputable news organization? Yeah, sure.

The Mistake Meisters At Fox News Bash MSNBC For Making A Mistake

From the Throwing Stones division of Glass Houses, Inc., comes this story of Fox News finding it irresistible to hammer MSNBC for airing a segment with a conspicuously mislabeled map. This evening their community web site, the Lie-riddled Fox Nation, posted an item pointing the finger of shame at MSNBC.

To be sure, MSNBC’s graphics department has cause to be embarrassed. They managed to post a map with four cities highlighted and misplaced every one of them. It’s hard to imagine how they could have screwed up so badly without suspecting that new intern who used to work for Fox.

However, it takes a special kind of Chutzpah sauce for Fox to go out of their way to report their competitor’s error. Fox has made so many mistakes of this sort that they had to send out a “Zero Tolerance” memo threatening their staff with termination if they didn’t clean up their act:

“Mistakes by any member of the show team that end up on air may result in immediate disciplinary action against those who played significant roles in the ‘mistake chain,’ and those who supervise them. That may include warning letters to personnel files, suspensions, and other possible actions up to and including termination.”

Faux PasThat memo appeared to have no effect since the errors kept occurring unabated. Fox would mess up charts. They would mess up photos. And most of all, they would mess up maps.

The graphic below shows just a few of the egregious errors that have graced Fox News. They placed Egypt, instead of Iraq, in between Syria and Iran. They labeled Vermont as New Hampshire. They colored in Utah but called it Nevada. And, my personal favorite, they listed one of Japan’s nuclear power facilities as “Shibuyaeggman.” The problem is that there is no reactor in Shibuyaeggman. In fact, there is no Shibuyaeggman. Although, there is a disco called Eggman in a Tokyo neighborhood called Shibuya, and while the dance action is hot, it is not reported to be radioactive.

It’s bad enough that Fox gets their actual “news” stories wrong with phony reports and analyses that distort facts, or leaves them out altogether, but they can’t even get the simple things right. Sure, everyone makes mistakes, but Fox has made mistakes their specialty.

REVEALED: Fox News Bumped Sean Hannity For Pro-Homosexual Megyn Kelly

Megyn KellyThe recent stories circulating about “news” anchor Megyn Kelly and her promotion to a primetime slot on Fox News have stirred much speculation as to which current primetime host would be displaced. Matt Drudge reported that insiders pegged Sean Hannity as the odd man out. Well now the truth has now been revealed by the folks at Cliff Kincaid’s “America’s Survival,” an ultra-rightist hate-group and conspiracy theory factory. (Not to be confused with the Lie Factory of Fox Nation)

“America’s Survival, Inc. (ASI) is officially releasing a new report on radical changes at Fox News that should cause great concern to pro-family conservatives. The new report is titled,’Unfair, Unbalanced and Afraid: Fox News’ Growing Pro-Homosexual Bias and the National Lesbian & Gay Journalists Association. ASI President Cliff Kincaid, a veteran journalist and media critic, said, in releasing the report, ‘Pushing Sean Hannity out of the 9:00 p.m. slot, to make way for pro-homosexual advocate Megyn Kelly, is another sign of the channel’s left-ward drift and decline.’

Indeed. The left-ward drift of Fox News has been all too apparent in their recent coverage of Benghazi, the IRS, Trayvon Martin, ObamaCare, etc. Fox has become a veritable cacophony of commie sympathizers. So it was only a matter of time before Fox would jettison their old-school conservative Sean Hannity, and replace him with a doctrinaire liberal like Megyn Kelly.

Kincaid’s new report (pdf) was authored by the rabidly anti-gay Peter LaBarbera of Americans For Truth About Homosexuality, an organization identified by the Southern Poverty Law Center as a hate group. LaBarbera delved into the pressing calamity of the media promoting homosexuality with an introduction that warned…

“It is difficult to overstate the impact of wide-scale liberal media bias in the advancement of the pro-homosexual and pro-‘transgender’ revolution in American society. In the last two decades, media imbalance (and de facto censorship) on the issue has morphed into frequent media celebration of homosexuality — thus leaving citizens starved for impartial and accurate information on this critical topic.”

And it just gets worse from there. The 92 page harbinger of doom begins by disclosing the existence of a “crusade” that has enveloped the media, including those stalwart protectors of America’s virtue.

“By effectively joining the ‘gay’ activists’ crusade, major media outlets – and even ‘conservative’ Fox News — have contributed greatly to the growing pro-homosexual political correctness in U.S. culture.”

And no one is immune to the infection of gay pridefulness.

“Some leading Fox News’ hosts, such as Bill O’Reilly, Shepard Smith and Megyn Kelly, have emerged as on-air, pro-LGBT advocates – seemingly defying Fox’s core audience demographic of staunch Republican conservatives.”

LaBarbera has astutely defined the Fox demographic as the hate-filled bigots they are. And he follows that observation with a pertinent query.

“One wonders how much of Fox’s liberal ‘message drift’ stems from it’s staff simply losing touch with churchgoing Americans and that old-fashioned, Bible-believing morality that once was the backbone of conservatism.”

Of course. Because it’s imperative that our news networks are also televangelists. But now we get into the meat of the matter as Hannity’s role is unveiled.

“Veteran pro-family activists who fight the LGBT agenda are frustrated that Hannity generally avoids discussing homosexual-related issues outside of ‘gay marriage’ — despite labeling himself as a social, ‘Reagan conservative.'”

If only Hannity had been more staunchly committed to serving the God of America like his network colleague from Fox & Friends.

“Gretchen Carlson is an assertive moral conservative of the type that Fox needs more of.”

Although, if Fox is leaning so far left, then why would they promote a good Christian broadcaster like Carlson into the daytime slot that Kelly is vacating?

It’s fair to say that not much of this makes any sense. The report touches on some other fantastical schemes such as LaBarbera’s belief that there may be “an internal edict from Fox News higher-ups to downplay or ignore focusing on the homosexual agenda.” And then there these fanciful speculations: “Shepard Smith: the next Anderson Cooper?” and “Will Glenn Beck join the ‘gay’ crusade?” America wants to know.

Now that we know the truth about Megyn Kelly’s promotion, and Hannity’s demotion, it will be interesting to see how she advances the gay agenda when her new program debuts in the fall. Likewise, we will be watching Hannity to see if his transformation into a LGBT advocate becomes complete. And we can thank LaBarbera and his sponsors at America’s Survival for keeping such a close eye on the progressivization of Fox News for us.

Fox News Host Mike Huckabee And Ted Nugent: Let’s Hunt Democrats

In yet another example of the right-wing’s incendiary rhetoric promoting violence, Fox News host Mike Huckabee invited NRA board member and washed-up schlock-rocker Ted Nugent onto his radio show to engage in a dialog about the issue that matters most to the Teabagging community: Destroying Democrats.

Glenn BeckIt didn’t take long before the pair diverted their conversation about the joys of killing defenseless animals, to their undisguised lust for Democratic blood. Nugent began by singing the praises of his dog Gonzo…

Nugent: He really is a mystical, wonderful, huntin’ dog.
Huckabee: Well, maybe we ought to turn him loose on some Democrats and see if he can hunt them too.
Nugent: Well, there’s a lot of varmints out there.

This is typical of the way that conservatives seek to dehumanize their ideological foes. It is evident in the recent comments of GOP Rep. Steve King who compared undocumented immigrants to dogs and mules. It is evident in the Republican references to Democrats as slave masters. And it was displayed again today when Glenn Beck spoke in his customary delusional style about progressives that he imagined were sneaking into the bedrooms of children to smother them with pillows.

This sick obsession with characterizing people with whom you disagree politically as subhuman or murderous monsters has been going on for the entire term of Barack Obama, coincidentally the nation’s first African-American president. But I’m sure there is no connection.

Media By Ass: Breitbart Editor Launches TruthRevolt Site To Counter Media Matters

The diseased minds at Breitbart News and David Horowitz’s Freedom Center are joining together to fill what they perceive as a void in media criticism. Not satisfied with the efforts by richly financed conservative operations like the Lie Factory of Fox Nation, the Media Research Center’s NewsBusters, the Washington Free Beacon, or Breitbart’s own BigJournalism, this new cabal is forming with the unmistakeably hostile mission to…

“…unmask leftists in the media for who they are, destroy their credibility with the American public, and devastate their funding bases.”

Oh my. That’s sounds ominous. But if anyone is capable of venturing down such a repugnant path, it’s BreitBrat Ben Shapiro, the editor-at-large of Breitbart News. Shapiro’s record of keeping the media in check includes falling for a fake story about Chuck Hagel; bashing fact-checkers; whining when Republicans are vetted; and exposing the socialist propaganda of Sesame Street.

As for BreitBrat Ben’s partner, David Horowitz, he is a notoriously racist fringe conservative who believes that slave labor has benefited contemporary African-Americans. He also publishes “Jihad Watch,” which has labeled President Obama a “practicing Muslim.”

The new TruthRevolt project describes itself as “a conservative counterpunch to Media Matters, the Obama-linked organization that focuses on silencing conservatives in the media.” Of course, there is no Media Matters link to Obama offered by the BreitBrats, nor any evidence that they have ever silenced any conservative. What right-wingers regard as silencing is really just getting caught saying what they actually believe. That’s all that Media Matters does.

Breitbart has been after Media Matters for a long time. They have challenged the tax-exempt status of Media Matters; accused them being anti-Christian and anti-American; charged that they get their marching orders from the White House, George Soros, or any other convenient rightist bogeyman. Even their hallowed leader, St. Andrew, has taken cheap shots at Media Matters and its founder, David Brock. He published an absurd article alleging some sort of conspiracy by the media to hide an old photograph of Brock that he characterized as narcissistic and homoerotic. But he could have been talking about himself and the photos he posed for in Time Magazine:

Breitbart’s destructive tendencies are well documented. He once swore to “bring down the institutional left” in three weeks. He’s more than four years overdue. Now his successors are nursing the same obsessions. And as usual they are incapable of providing a single example of anything that Media Matters has done that was incorrect or deserving of criticism. Their unambiguous goal (as they admitted above) is to tear down an organization that does nothing more than document the conservative bias in the media. It is a plainly articulated, well-financed, censorious revolt against truth – hence their name.

Bigots On Fox: Capitalist Pig On Fox News Lives Up To His Name

Jonathan Hoenig is the manager of the Capitalistpig Hedge Fund and a Fox News contributor who appears weekly on “Cashin’ In.” He routinely blurts out ignorant rants such as declaring that access to health care makes everyone a slave, or that kids would do better on the streets than in public school, or that Social Security should be scrapped.

On this week’s edition of the program (video below) Hoenig demonstrated that he is not above religious bigotry to make a dubious point and to slander a Democratic congressman.

During a discussion about the Inclusive Prosperity Act (aka the Robin Hood tax), a bill that would impose a fee of a fraction of a percent on certain financial transactions, Hoenig abandoned any pretense of debating the merits of the bill and instead decided to attack the bill’s sponsor, Keith Ellison, for his religious beliefs.

Hoenig: I don’t know if Rep. Ellison has read the Constitution. I know he is a practicing Muslim and in Sharia law, there is a prohibition against trading of derivatives, against speculation of any type. And so in my opinion you could make the argument this is even a little bit of Sharia creep here with the cracking down on trade, cracking down on the derivative trade, cracking down on wealth production.

The only “creep” here is Hoenig. His repulsive attack on Ellison’s faith is not only evidence of his ingrained hatred, but he makes no sense whatsoever on a financial basis. Nothing in the bill prohibits derivative trading or any other stock transaction. And in addition to generating billions of dollars, the nominal fee would produce a more stable trading environment that in recent years has become dangerously volatile.

The fact that Ellison is Muslim has nothing to do with the bill. It is co-sponsored in the House by 17 representatives who are mostly Christians (and at least on Jew). Hoenig is obviously not an expert in Islamic practices. Millions of Muslims invest in equities markets in the United States and around the world. That includes one Muslim named Al-Waleed bin Talal, a Saudi prince whose share of stock in the network Hoenig is broadcasting on is exceeded only by Rupert Murdoch and his family.

Furthermore, Hoenig’s snide curiosity about whether Ellison has read the Constitution only reveals his own constitutional illiteracy. Article I, Section 8 of the Constitution explicitly grants authority for the government to assess taxes and fees such as the one in Ellison’s bill.

This segment is the perfect capsulization of Fox’s abhorrent philosophy and mission. It illustrates both their overt contempt for anyone who is not a member of their preferred fraternity (in this case Muslims), and their kneejerk opposition to any tax measure that benefits the nation if it imposes even a tiny burden on the wealthy and greedy corporations whose rights they regard as superior to the people.

Media Goes Silent As Texas Defends Constitutionality Of Racial Discrimination

In what may be the most under-reported story of the year so far, the media has virtually ignored the shameful response by the state of Texas to a Department of Justice challenge of voter discrimination in the state.

In June, the right-wing majority in the Supreme Court struck down a key provision in the fifty year old Voting Rights Act of 1964. In doing so they sanctioned efforts by racially biased state governments to discriminate against minority residents and other voters they want to suppress.

Attorney General Eric Holder moved quickly to mitigate the harm caused by the decision. He directed the Justice Department to seek a court ruling to require Texas to get permission from the federal government before making changes to their voting laws under a different section of the VRA.

Last week Texas responded to the DOJ filing with an astonishing admission that the intent of their voting reforms is to discriminate. They masked the ultimate purpose in a political argument, but the result is unarguably racist and unconstitutional. Rick Hasen of the University of California at Irvine caught the offensive passage in the Texas filing:

“DOJ’s accusations of racial discrimination are baseless. In 2011, both houses of the Texas Legislature were controlled by large Republican majorities, and their redistricting decisions were designed to increase the Republican Party’s electoral prospects at the expense of the Democrats. It is perfectly constitutional for a Republican-controlled legislature to make partisan districting decisions, even if there are incidental effects on minority voters who support Democratic candidates.”

The argument by the state of Texas is that they are deliberately discriminating against Democratic voters, not minorities or other protected classes of citizens, and they regard that as permissible. The first problem with their argument is that it is questionable to assert that it is constitutional to “make partisan districting decisions.” Any overt attempt to suppress the voting rights of any citizen is challengeable and potentially in violation of civil liberties.

More to the point, the claim that they are only aiming their discriminatory activities at Democrats is disingenuous and unsupportable. The redistricting maps proposed by the Republican-controlled Texas legislature cut obviously across racial boundaries. The clear intent is to segregate blacks and Latinos into the fewest number of districts possible, denying them equal representation. These maps were struck down by federal courts as blatantly discriminatory, but now the state can re-introduce them with the blessing of an atrociously reasoned Supreme Court decision.

There is simply no way to pretend that the statement made in the filing defending the constitutionality of discrimination against Democrats is anything other than a defense of discrimination against minority communities in Texas. Given the demographic breakdown of the district mapping, it is absurd and grossly dishonest to assert that the “effects on minority voters” are “incidental.” What the state of Texas is doing is racism, pure and simple.

So where is the media coverage of this outrageous admission made in an official court document? None of the television news networks has reported on it. None of the major national newspapers has published a story about it. A few Internet news outlets have done some commendable reporting on it, but their reach is minimal at this point.

Without the establishment media informing the nation that this sort of institutionalized racism is going on, it will continue unabated. And if there is one thing that this proves other than the fact that racism is still deeply ingrained into some of our government systems, it’s that the conservative complaints about media are wholly without merit.
